By accessing this website, requesting service, submitting a form, calling/texting us, or scheduling work, you agree to these Terms & Conditions (“Terms”) and our Privacy Policy section below.


🧾 1. Services We Provide

RTC provides HVAC-related services including (but not limited to): diagnostics, repair, maintenance, replacement, and installation of heating and air conditioning equipment and related components.

Service availability may vary by location, weather conditions, parts availability, technician availability, and safety considerations.


📍 2. Service Area, Travel, and After-Hours Availability

We are based in Winter Haven, Florida and typically service surrounding areas throughout Polk County and nearby communities.

  • Standard service areas are generally within a practical travel radius from Winter Haven.

  • Extended travel or distant locations may include additional travel charges or scheduling limitations.

  • After-hours / emergency service may be limited to certain areas and may include higher rates due to staffing and availability.

If you’re unsure whether your address is within our current coverage, contact us and we’ll confirm availability.


📅 3. Appointments, Arrival Windows, and Access

Appointments are scheduled based on availability and may include an estimated arrival window.

You agree to:

  • Provide accurate address, entry instructions, and contact information

  • Ensure safe access to the equipment (attic access, gates unlocked, pets secured, etc.)

  • Ensure a responsible adult (18+) is present when required

If we arrive and cannot access the equipment, the visit may be treated as a completed service call and fees may apply.


💵 4. Service Call Fees, Estimates, and Approval

A service call/diagnostic fee may apply and is typically due at the time of service unless otherwise agreed.

Estimates & pricing

  • Any estimate is based on visible/known conditions at the time of inspection.

  • HVAC work can uncover hidden issues (electrical damage, code issues, improper prior installs, corrosion, etc.).

  • If additional work is required, we’ll communicate options before proceeding when reasonably possible.

Approval

  • You authorize RTC to perform work you approve verbally, in writing, via text/email, or by signature.

  • If you request that work begin before you are physically present, you accept responsibility for approvals provided remotely.


🧰 5. Parts, Equipment, and Substitutions

We use manufacturer-approved or industry-appropriate parts when available.

You acknowledge:

  • Parts availability may affect timelines

  • Equivalent parts may be used when exact matches are unavailable or discontinued

  • Equipment selection may depend on compatibility, sizing, code compliance, and supply conditions

Special-order parts may require deposits and may be non-refundable once ordered.


🧾 6. Payments, Deposits, and Non-Payment

Payment is due as stated on your invoice or agreement.

We may require:

  • Deposits for special-order parts or large installs

  • Payment upon completion (or milestone payments for multi-day jobs)

If payment is not received when due:

  • We may pause work, withhold non-required documentation until payment is made (where lawful), and/or pursue collection remedies allowed by law.

  • You agree you are responsible for reasonable costs of collection where permitted.


💳 7. Financing (If Offered)

Financing options, when available, are provided through third-party financing partners and are subject to approval. RTC does not control financing decisions, interest rates, or approvals/denials.


✅ 8. Customer Responsibilities and Site Conditions

You agree to maintain a safe working environment, including:

  • Safe access to the work area

  • Reasonable lighting

  • No aggressive animals in the work zone

  • Disclosure of known hazards (mold, asbestos, pests, unsafe wiring, unstable flooring, etc.)

If unsafe conditions exist, RTC may refuse or stop work.


🛡️ 9. Warranties and Disclaimers

Manufacturer warranties (if applicable) are provided by the manufacturer, not RTC. Warranty coverage may depend on product registration, maintenance, and other manufacturer rules.

RTC workmanship warranty (if offered) applies only to labor performed by RTC and excludes:

  • Pre-existing issues

  • Improper maintenance or misuse

  • Damage from power surges, floods, storms, corrosion, pests, or “acts of God”

  • Work performed by others after RTC service

  • Normal wear-and-tear

If you suspect a warranty issue, you must notify us promptly and allow a reasonable opportunity to inspect.

FTC guidance generally expects clear warranty disclosures and accurate representations. 


⚠️ 10. Limitation of Liability

To the maximum extent permitted by law:

  • RTC is not liable for indirect, incidental, special, consequential, or punitive damages (lost profits, business interruption, loss of use, etc.).

  • RTC’s total liability for any claim related to services or this website is limited to the amount you paid RTC for the specific service giving rise to the claim.

Some states limit these disclaimers; in those cases, limitations apply to the fullest extent allowed.


🧯 11. Emergencies and System Failures

HVAC failures can involve unpredictable risks (electrical hazards, refrigerant leaks, water damage, mold risk, etc.). RTC will take reasonable steps to diagnose and repair issues safely, but cannot guarantee:

  • Same-day repair completion

  • Availability of specific parts

  • That a temporary fix will prevent future failure


📣 12. Communications, Calls, and Text Messages

By submitting a form or contacting RTC, you consent to receive communications by phone, text, or email regarding:

  • Scheduling

  • Estimates/invoices

  • Service updates

  • Follow-ups

Message/data rates may apply depending on your carrier. You can request to opt out of non-essential texts at any time.


🔁 13. Cancellations and “Right to Cancel”

If a service agreement qualifies as a door-to-door / home solicitation sale under applicable law, you may have a legal right to cancel within a defined period. Federal FTC guidance describes a common “cooling-off” cancellation window for certain sales made at your home. 

Not all HVAC service calls qualify. If a cancellation right applies, RTC will provide the required notice.

If a dispute occurs, you agree to first contact RTC and allow an opportunity to resolve it informally.

If unresolved:

  • Claims may be brought in a court of competent jurisdiction in Florida, unless another venue is required by law.
